Texas Separation Agreements |
|

|
Texas law does not include a provision for legal separation. Texas is a community property state. Because of this, living separately from your spouse does not mean that any income or property you acquire while separated is yours alone. A court may decide to grant a temporary order concerning child custody issues and marital property. Such an order would only apply if a divorce proceeding had already begun, and would be applicable only while the divorce was pending.
